IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF PEQUOD'S PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. YOU AND PEQUOD'S PIZZA EACH AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR IN COURT, WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to bring or participate in a class action lawsuit or class-wide arbitration. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
12.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent immediate irreparable harm pending arbitration. Additionally, claims arising under intellectual property laws may be brought in a court of competent jurisdiction.
12.5 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY APPLICABLE LAW, BOTH PARTIES HEREBY KNOWINGLY AND VOLUNTARILY WAIVE THEIR RESPECTIVE RIGHTS TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS.
13. Term and Termination
